Still, isn't that repair obvious evidence of prior water damage, and isn't that supposed to be disclosed when selling a house? Did you ask the if there was a history of water or other damage? If so I hope the response documented?
We can't tell from the pics but was this repair visible from the ground at any angle?
The situation sucks either way, I hope you can get some compensation.
I will provide interior photo's showing that this was happening for awhile...
It is not visible from the ground as it is on the second story.
No mention at closing of any water damage. This guy worked for a developer and was separated from his wife for the last 3 years...The only person living in the house for the last 6 months was the son...
Mom acted like she had a prior stroke and was not to coherent..
Waiting for the lawyers take on this as he is looking over the documentation.
I do not believe the man of the house knew of of this as the whole house was in prime condition and was very thorough with receipts etc...So `who knows

This blows but disclosing prior damage is not required for most repairs. Given enough time every structure will need some kind of repair. A repair is not necessarily a bad thing. Usually it means a conscientious homeowner has taken care of the house. Looks like in this disjointed occupancy someone thought they had gotten a repair job and never looked.
The best you can probably expect is a return of the inspection fee and/or the PO paying a nominal fee for a repair. If the PO is smart they'll put a cap on it. After all, it's your house now with no warranties. I'd get the agent to lean on the inspector since he/she is referring them business. You'll probably get nothing. Lawyering up isn't cheap and it's hard to tell if spending lawyer money vs spending money on the repair is worth it.
Best of luck. Decent folks will make it right.
Give the inspector my card...

That's not correct. The standard Virgina contract requires the seller to disclose any 'material defect'. This example apprears to meet that test; its an obvious defect, the seller was obviously aware of it, the continued leaking would need to be proven but its clear that its still leaking and I'll bet it looks a lot worse inside the attic space than in these pics.
That said, VA is a 'buyer beware' state. You would need to show that the defect was known but not disclosed by the seller, and by the agent if the seller had told the agent.
If you wanted to act, sue everyone is the best approach; the seller, the agent, the agent's broker, the inspector. It might only take a couple of letters to spring a settlement offer.

...Then spend an afternoon and add a flashing dam to correct the stupid build method. Pull the roofing back in a long angle up the wall and flash up and angle in towards the siding cut the siding back with a box knife and slide the flashing under it. Use good flashing cement to caulk and be done with it. both the roofing and siding get angled back and the flashing covers the area where the water or snow and ice gathers and sits.

If you are good with sheet metal soldering, installing a stainless steel or copper cricket is the way to go, as it won't rely on sealant (which has a limited service life) in the seams to keep out the water. My guess is the old flashing was removed by the painters (may have been in poor condiiton) and replaced with the expanding foam/ sealant...

Not if it has been repaired. It's a fine point in the language but if it leaked and the leak has been fixed it no longer needs to be disclosed. It makes sense because you aren't going to keep a list of repairs over 10, 20, 30 or 40 years.
It does sound like the seller may not have been fully aware of everything going on in the house. Doesn't make it right but to elevate to a lawsuit would cost more than the repair maybe?
Depends on the severity and cost of the repairs, and the principal of it I suppose, do you want to pursue it?
I wonder if there was ever a claim of water damage on the title or insurance. I was of the understanding those types of claims stayed on the record forever even after a repair.
The point about repairs not needing to be disclosed only makes sense IF it was permanent. From what's been described this repair wasn't and hasn't been.

I don't know specific title insurance parameters but I would think that would have to be catastrophic water damage like a major flood or katrina type damage. Every house has or will have roof leaks so every title would have issues.
If the seller thought it was or was told by the hack painter that it was (jk roundy) then no disclosure. For sure this is a crap repair but the seller hadn't lived there in a while so he may not have known that the leak was ongoing. That foam could have been the "window and door" variety for all we know :)
Not defending the seller I just doubt how far this would go. Spending $300 for an attorney to send a letter may shake some money loose but a full blown lawsuit will only spend everyone's money IMHO.
Nothing is permanent.

An old repair that has failed is a new defect. Lots of case law in VA to support that holding.
Its not something you would litigate, but a few letters might spring a offer to settle. Given the heavy rain we've had since March, its hard to make the case that nobody knew about this [very] active leak.

I was nailed today driving in Baltimore. I was in the rightmost of two lanes that turn left. As I turn left, the car to my left tries to go straight from her "turn only" lane...into me. She hit me in the left rear side of my pickemup truck which rotated nicely with howling tires. A big correction kept me from smacking some bollards backwards. I pull over after catching it, she follows and jumps from her car to apologize and see if I am OK. I was fine, the truck has a teeny dent, but it is a 13 year old Tacoma so Jimmy Crack Corn. Now it matches the other side. Her Jeep seemed fine so we parted ways without any issue made. The pedestrians that witnessed it gave her more crap than I did. It was funny.
Her driving: fail. Admitting it was her fault: win. Getting hit while driving the beater: win.

How did he manage to get out on track after being solo'd - with a passenger? I didn't think that was allowed.
I'll do FATT, and it is great to run with a mix of cars. The usual stereotypes apply with the 'Vette and Shelby Mustang drivers. They open 6 car lengths down the front straight, then you're on their bumper by T3......they don't seem to like that! ;)
I was at a party last night and saw a ruby red CTS-V. It looked like a flying brick to me, but pretty mean looking front end. It had some kind of camera in the grille - nightvision maybe? I guess if you had to buy an 'Mericun 4 door, not a bad choice.

As he began his daring overtaking manoeuvre, Arthur Manning wondered if he was sailing a little close to the wind.
In fact, he was too close to the rocks. His yacht, the Jersey-registered Knight Star, ended up grounded and then wobbling in mid-air on its 6ft keel as the tide went out near Saint-Quay-Portrieux, north-west France.
Mr Manning, who was trying to speed ahead of 19 rivals in a Royal Channel Islands Yacht Club race, described it as 'an embarrassing misjudgment'.

FREDERICK COUNTY, MD - Drivers may experience delays on Route 75, near the Interstate 70 interchange in Frederick County, after a state trooper crashed his car duringa chase.
Witnesses say he struck an embankment after swerving to miss another car.
They believe the trooper was chasing a speeding suspect, who was driving a motorcycle.
Route 75 remains open, but drivers are being directed around the crash site.
No one was hurt, and officials say the suspect has not yet been caught.

VW to pay $11.28 billion for all of Porsche: report
Sat Jul 18, 2009 7:43am EDT
FRANKFURT (Reuters) - Porsche SE's controlling families will agree on Thursday to accept an offer by Volkswagen to buy its sports car business Porsche AG for roughly 8 billion euros ($11.28 billion), Der Spiegel reported on Saturday.
Germany's leading weekly magazine wrote that the rival Porsche and Piech clans, which own 100 percent of Porsche SE votes, will approve the two-stage takeover at a supervisory board meeting on July 23.
Volkswagen would purchase a 49.9 percent stake in Porsche AG and at a later date acquire the rest, in a deal that would create an integrated automotive group with 10 brands under the leadership of the Wolfsburg-based carmaker.
The sale would help Porsche SE pay off most of its debt, which two sources told Reuters has ballooned to considerably more than 10 billion euros.
Der Spiegel also said embattled Porsche SE and Porsche AG Chief Executive Wendelin Wiedeking is negotiating over a severance package that could total more than 100 million euros. In the meantime, production chief Michael Macht will replace him as head of Porsche AG, the magazine reported.
On Thursday, Wiedeking rejected speculation he was about to leave the group.
Asked on Saturday whether the two families have reached a decision for the July 23 board meeting, Porsche spokesman Anton Hunger said "we have not been informed of one," adding that the Spiegel report was speculation that the company would not comment on.
Separately rival German weekly magazine Focus reported that Volkswagen's powerful chairman and part-owner of Porsche, Ferdinand Piech, plans to remove Wiedeking on Thursday from the influential six-man steering committee on the VW supervisory board.
The vacancy could open up the opportunity for Piech's cousin and rival, Wolfgang Porsche, VW supervisory board member and Porsche SE chairman, to replace Wiedeking in the committee as a representative of his side of the family.
The grandfather of Wolfgang Porsche and Ferdinand Piech was Ferdinand Porsche, designer of the Beetle and founder of Volkswagen.

this is on the daily (05 toyota matrix xrs). i still have about 1/2 - 2/3 of the backing plate thickness of actual pad material left. you can kinda see the thickness of the pad material in the second pic near the wheel spoke (backing plate, tiny glimpse of pad material, worn rotor surface). you can also see the reflection of the backing plate in the rotor surface in that second pic. definitely time to replace them, but i was hoping i could put it off for a little while. going back to blank rotors but switching from hawk hps to ebc redstuff pads.

dunno... haven't taken it apart yet. i'm guessing a piece of something (perhaps a piece of the leading edge of the pad) got stuck between the pad and the rotor for a bit before it worked itself out in one of the slots. parts should be here tomorrow or friday, so i'll update this weekend with what actually happened.

Open it up to verify that the offending debris is gone and then put it back together. Those grooves wont hurt anything once the pebble or whatever is removed.

update: the pad was a little too worn on one side. toyota says 1mm minimum, and i had more than that, but it seems that hawk wants you to have more like 3mm minimum. i threw on a freshly machined OEM rotor i had lying around to hold me over until my new pads/rotors arrive. it of course is getting some nice scores of its own now.

Science Shows...
The Free Credit Report guy is right.
A British insurance company called Hiscox (seriously?) conducted the study (http://blog.wired.com/cars/2008/09/weve-got-some-b.html). They found when female subjects heard the roar of a Maserati's engine, they went to their happy place down south. Out of the 40 women who participated in the study, every last woman reported getting that tingly sensation from the sports car.
http://cdn-www.cracked.com/articleimages/dan/sex_myths/cars3a.jpg
So maybe you're thinking that being "green" and "economically responsible" might turn some women on, right? After all, chicks dig a guy who cares about the earth! Well, not so much. The study also concluded that not only were both guys and chicks turned completely off by the sound of a VW Polo, but it actually lowered everyone's testosterone level.
http://cdn-www.cracked.com/articleimages/dan/sex_myths/cars4.jpg
So when you're rolling around in the Volkswagon or Prius and some frat boy named Tyler calls you a pussy, sadly he's actually got science on his side.

CINCINNATI -- A Price Hill man is facing OVI charges and possible deportation after police say he tried to pull over a woman for driving drunk, when actually he was the one under the influence.
According to court records, a woman driving flagged down a Cincinnati police officer claiming a man was following her and flashing his SUV’s lights acting like a police officer trying to get her to stop in the 4500 block of West 8th Street early Saturday morning.
The man, who allegedly gave police a fake name but was later identified as 23-year-old Jose Lopez, originally from Guatemala, told police he thought the woman was drunk and just wanted to stop her.
After investigating, the officer realized that Lopez was actually drunk and the woman he was following was sober.
Lopez is charged with OVI, driving without a license and is awaiting action from Immigration and Customs Enforcement that could lead to deportation.
Don't make fun of the Bushs.

That's it! Note how the video sound is overwritten after he pulls over to collect video of the incident. Basically, she's yelling at him telling him to move past the incident. They guy was a huge tool. The video also shows that the Acura was not tangling with the Mitsu. It was in line ahead of the Infiniti.
Here's a forum thread discussing the video-guy. http://www.lotustalk.com/forums/f100/reminder-what-can-happen-22812/index4.html
He was subsequently banned for recklessness at a Watkins Glen event. Audi drivers! Sheesh.

I have a Sony TV that looks just like that (but 12" screen) in my office waiting to get thrown out (it was my grandfather's) and my parents have (had?) an almost-identical Betamax to that one sitting in their attic. Wired remote. But it recorded better than any "Super-VHS" I ever saw.
Anyone want the TV?

How about this device... anyone remember these? Not a fail, really, but darn crude compared to today's technology.
http://z.hubpages.com/u/275469_f260.jpg
The Zenith Space Command remote control was introduced in 1956. A simple handheld unit, it was similar to the ones we know today. Inside were four small aluminum rods cut to different lengths which, when struck, would emit a specific sound frequency. The striking was accomplished by small hammers connected to springs, which were triggered by four control buttons. The buttons controlled the power, volume on and off, and channel up and down. It did have one drawback. It was occasionally known to respond to other metallic sounds, like jingling keys, or dog tags.
The sound made by the tiny hammers striking the rods gave birth to the nickname that would endure for generations. Perhaps you are one of the millions of people that refer to your remote as the "clicker".
This was an expensive feature, as it required a special receiver to be added to the tv. Adding as much as 30 percent to the price of a set, it still sold like crazy. It perservered in various forms for 25 years, until the early eighties, when ifrared came on the scene.
