Reckless driving....a boat
Was having a great time this weekend, had my daughter and her boyfriend (maybe the one) along with some friends and young adult children down at the lake. We were skiing, wakeboarding and tubing all day. Around 4:00 pm we notice the police looking us over and then the lights go on. I figure no big deal, I have a current registration and license, enough life preservers for everyone, a class 4 (throwable float), charged fire extinguisher and working horn. No underage drinkers on the boat, I was driving and not drinking.
At the time I was pulling two 60 year old woman on a lounging tube (big thing with backrests, cupholders, etc) at 15 mph, very sedate. Well one of my passengers was sitting on the gunwale and apparently this is considered "reckless boating". Since I was the operator I was cited. I'm thinking no big deal again, just pay the fine, but have come to find out that "reckless" boating in a Class 1 criminal misdemeanor. The same charge as a DUI. Hardly seems that punishment fits the "crime". Anyway, anyone ever deal with this before or know an attorney in Campbell county VA that handles these things. Needless to say I cannot have a criminal charge on my record without have serious consequences for my clearances. TIA Stephen

OMG, that's insane. I don't have any legal recommendations, but I hope you find a way to reverse such a disproportional punishment.

Holy crap. That is one over zealous officer. For a guy that is doing everything correct that really sucks. You would think he would acknowledge that you were boating respectfully and probably to him, strangely sober especially on a holiday weekend. Rookie cop? Training someone? Is his name Barney? I wish I had a good attorney recommendation but I don't, sorry.

I saw a report this past weekend that the MD DNR was giving warnings for this. Apparently the MD general assembly changed the law this year due to an accident where a kid fell off the front of the boat (https://www.washingtonpost.com/local...=.c5957264ce34)

I bet this was on Leesville Lake. Same thing happened to me in 2013. I appeared and pleaded not guilty as my oldest son was providing audio feedback on on how his brother was doing on the knee board. This changed his status from passenger to crew. No sitting on gunnel or gunwale while craft is underway only applies to passengers, NOT boat crew. I paid the court fees, and was out of there in less that 1 hours.

Some boat laws are silly, my brother got nicked for something as silly (if not sillier) as this many moons ago.

It did happen on Leesville lake! Did you have an attorney or were you able to find the law/regulation on line somewhere?

So because the officer doesn't ask "Is this person your crew", and the boat driver doesn't say "That person is my crew", they make you waste time to go into court so the judge can ask you the question, and then move their court fees from your pocket to theirs. My advice would be to bring someone from the media to properly report on the "antics".
