I'm just discovering this thread. What an outrage. This is the kind of thing I'd gladly drop some time and cash on to appeal, just to make sure the county does not earn a dime off of me. I may lose, but they'll lose more.

Dan, you really should contact someone at the Wash. Post on this. They would eat this up. The People's Republic of Fairfax Co. is a joke. It's such a kangaroo court. I've seen them let people go for passing a stopped school bus, give a slap on the wrist for DWI (before they stiffened the penalties), while throwing the book at someone doing 76mph (reckless) on a hwy in the middle of the night. I've beaten a few tickets there, but it sounds like I just got lucky.

My favorite Fairfax County police moment was when I was in highschool. Riding the schoolbus home, just leaving the school on the access road...a cop pulls over the bus and writes a ticket (w/ a load full of kids) for not doing a complete, stop, pause, look and go at the stoplight some 50 yards away from the school. Too funny, not for the busdriver I'm sure.

Nathan
PS: I hope I don't get stopped by them in the 914...wonder if I can get some leeway (sp) due to my antique tags?

....and the woman in Ohio who was breast-feeding while driving was found not guilty of child endangerment.

My son brought a related item to my attention. A former client of mine has received an honorable mention from the Darwin Awards. It is well deserved. Go here: http://www.darwinawards.com/ and look for "The Last Laugh".

p.s.--I would never describe him as "bright". One of his second set of lawyers said that.
