Default New Home Fail

All...Just 72 hours after closing on my new home and with all the rain we had in the last several weeks. I heard a dripping sound while I was upstairs cleaning...I assumed it was coming from the bathroom and sure enough yes the tub spout is dripping...No problem a 20 year old house will come with minor issues..

I walk back out to finish what I am doing and sure enough I hear a drip splash...Hmmm that sounds different

Sure enough in the guest room I hear water coming in and hitting the carpet from the closet...Grrr... I look up and sure enough right along the seam is a nice separation and water coming in at a nice clip...

I quickly get a bucket and decide I will contend with this later...Not enough light in the house the look any further...

All I could do was laugh...My wife is not laughing...I was joking with the contractor and we would have been happy to see duck tape...not spray foam and bathroom caulk...

Next day..Wife comes in the early morning to empty 1/4 - to about 1/3 of a bucket. I show up later after work with a buddy so that I can look in the atic...Empty about a 1/5....

I can not craw to the actual spot to the pitch of the roof is to steep.

I decide to cut out the drywall which is all wet and gooey...To my surprise a whole nest of ants come crawling out and on me...after spraying them and getting the entire closet ceiling drywall out... The roof wood is all rotted and I have a whole about 3 to 4 inches......

I did notice that their was imperfections near the seam as well as fiberglass tape...I do not recall that being used back in 89 when the house was built...I use to work for a residental developer for 3 years and did a fair amount of drywall..

Here are pictures of the prior owners craftsmanship or someone they paid...

This is not going to be fun...as this was not disclosed and the whole house was recently painted...So the inspector did not catch this and since the roof was done 10 years ago...The inspector did not go up and catch this as they seem to not climb ladders to 2nd floors in this day and age..

I'd bitch hard about that!!! Can't call yourself an inspector and not inspect!!! Try the Real estate agent then it's prolly time to lawyer up. At the very least you need to get the inspect $$$ back + I'd trash him all over town!!

The good ones do, and they are the ONLY inspectors to use. My wife is a realtor, and I am at every home inspection we do. She sells 40+ homes a year, and we will only use one of two inspectors. Period. Never had an issue arise after closing. There are other good ones, but here are also lots of duds.

I will be talking to a lawyer here shortly...and figure out from their....Ohhhh the joys of a new home ..but at least my girl has a 2 car garage all to herself plus 12 foot ceiling...and it is dry...

That sux. I'm not sure how much liability the inspector can assume, but its clearly a case of a lousy inspection. Are they bonded in any way? You may also have a case against the previous homeowner but might be hard to prove. Good luck.....I hope you get some sort of restitution.

I've heard that a lot of inspectors' contracts attempt to limit their liability to the amount of their fees.

I believe I have read that inspectors are not really controlled by any regulatory agency and have very little liability. Any asshat with a flashlight can claim to be an inspector.

I am sorry to read about how you were burned. That "repair" is one of the most retarded things I have seen in a while. Hopefully the egregious nature of the inspectors negligence will result in some compensation for you. I just served as an "expert" on painting this week for a guy that was getting screwed on a home remodel. He was able to get a settlement because the failures were very obvious.

Our inspector's contract had language restricting the liability to the amount of the fee. And he inspected our roofline only with binoculars, but he told us that was the extent of the inspection, and the roof is a single, uncomplicated apex.

Still, isn't that repair obvious evidence of prior water damage, and isn't that supposed to be disclosed when selling a house? Did you ask the if there was a history of water or other damage? If so I hope the response documented?

This seems like fodder for a strong case, yet Caveat Emptor. You'll have to accept some of the responsibility for not noticing such an obvious bogus repair on the roof.

We can't tell from the pics but was this repair visible from the ground at any angle?

The situation sucks either way, I hope you can get some compensation.
