All you have to dio is "not guilty". They have the burden of proving it was you, atleast in MD. Bad checks is one of the very few odd-balls where it is infered that you intend to defraud. Bounce a check and go to jail?!

The nut I am married to is dying to make a high speed run through the speed camera.....just to get a photo of the car with the speed on it. I keep telling her what a dumb idea that is.

you could just duck down out of sight as you go through the camera, so it would appear that nobody was driving the car, and you can't be convicted of driving a car that nobody was driving it, particularly if the picture shows nobody was driving.

not guilty plea only gets you a hearing before a judicial decisionmaker. in jurisdictions that use cameras, prosecutor's burden is met by introducing the pic of your car travelling at an illegal rate of speed. it is then incumbent upon defendant to come forward with a plausible explanation. i live in a group house and everybody has access to use my car and it couldn't have been me anyway cuz i was in brazil that day. better be convincing.

I thought that they set the statute up for speed cameras so that the ticket went to the person who's name was on the registration, not the driver. If you weren't driving then they'd say 'Fine you go collect from whomever you lent the car to'. Since there are no points and no moving violation it is like a parking ticket. They don't need to prove who parked the car in order to issue a ticket to the owner.

I have a few friends who are in LE. Most of the time, if a non-standard car like a Mitsubishi 3000 or something pulls you over, it's the officer's POV. You've probably done something incredibly stupid for them to take their free time to give you your spanking.

I had my old motorcycle up in MD at a shop for over a year. My registration had expired about 13 months prior to that day, and on the way home from the shop a Montgomery County officer in his Ford Ranger pulled me over. I thought I could get away since it was just to get to the DMV office, which I was then late for because of him.

When I went to court and showed the judge my DMV receipt from the next morning, and the picture of me on the day of the ticket in front of the DMV 15 minutes after they closed, he let me go.

So yeah, it was a boneheaded thing to try to get to the DMV on a 13 month busted tag, but it's not like I was pulling wheelies down 355.
