Yeah, well the LAWYER doesn't pay for anything (they just don't paid their contingency fee). And I've seen cases (where I was an expert witness) where the plaintiff certainly lost, but the court basically awarded some money for the attorney to get paid (something about sharks sticking together, remembering that judges are also lawyers).

Far be it from me to defend an ambulance chaser, but they only take a case if they think they can get paid. A case has value if the lawyer thinks he can win it, or if he thinks it'll be enough of a nuisance that the other side will settle for a decent amount.

So, even if the case is a real loser, would the insurance company for the hospital/Schwinn, etc. pay $20,000 in legal fees to defend/win the case, or pay $10,000 to the dirtbag ($3,333 of which goes to his dirtbag lawyer). Ironically, the cost that creates the opportunity for the dirtbag lawyer is the cost of the insurance company's lawyer!
